Is permission required to film or photograph a person?

Since the GDPR legislation went into effect on May 25, 2018, there has been strict monitoring!

What if the data subject does not give consent?

Then, of course, you may not bring the person into the picture.

Heavy fines are issued if the person is filmed but does not give or has not been asked permission.

But what if the data subject does consent to the processing of his/her personal data?

Then the requirement of one of the legitimate processing grounds is met.

But when do we speak of consent to imagery?

There are 6 conditions:

  • Specifically
  • It must be voluntary
  • Informed
  • Exhibit
  • Unambiguous
  • For minors, parental consent is required
