data-contrast=\"none\">Voordat we ingaan op de <b>concrete feiten<\/b> van deze zaak is het belangrijk om even teruggrijpen naar de<b> eerdere problemen <\/b>rond het <b>recht om vergeten te worden op Google.<\/b><\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\"><b>\u00a0<\/b><\/span><\/p><p><span data-contrast=\"none\">In <b>2014,<\/b> nog voor de<b> inwerkingtreding van de GDPR,<\/b> heeft het <b>Europees Hof <\/b>v<b>an Justitie <\/b>zich uitgesproken over het recht om vergeten te worden. <\/span><\/p><p><span data-contrast=\"none\">In het <b>Arrest Google Spain<\/b> (HvJ EU 13 mei 2014, <\/span><a href=\"https:\/\/curia.europa.eu\/juris\/liste.jsf?language=nl&amp;num=C-131\/12\"><span data-contrast=\"none\">zaak C-131\/12<\/span><\/a><span data-contrast=\"none\"> ging het om een geschil tussen <b>Mario Costeja Gonz\u00e1lez en Google.<\/b><\/span><\/p><p><span data-contrast=\"none\"> De klacht van de heer Costeja Gonz\u00e1lez vloeide voort uit het feit dat indien er op d<b>e naam Gonz\u00e1lez<\/b> werd<b> gegoogled<\/b> zoekresultaten verschenen over de openbare verkoop van gebouwen van de betrokkenen in het kader van een beslag ter <b>terugvordering van socialezekerheidsschulden.\u00a0<\/b><\/span><span data-contrast=\"none\">De veiling dateerde echter al van vele jaren daarvoor.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p><p><span data-contrast=\"none\">Het <b>Europees Hof van Justitie <\/b>oordeelde in deze zaak dat de activiteiten van een <b>zoekmachine als Google aangemerkt moeten worden<\/b> als verwerken in de zin van de <b>oude privacyrichtlijn.<\/b><\/span><\/p><p><span data-contrast=\"none\"> Dit komt erop neer dat Google steeds een <b>rechtmatige grondslag<\/b> voor de verwerking van deze persoonsgegevens dient te hebben, waarbij het privacybelang van de aanvrager en het belang van het <b>recht op vrijheid <\/b>van meningsuiting en<b> recht op informatie tegen elkaar <\/b>dienen te worden afgewogen.<\/span><span Gonz\u00e1lez voorrang op het eventueel <b>economisch belang<\/b> van Google \u00e9n op het belang van het publiek om informatie te verkrijgen.\u00a0<\/span><span
