De AML vermeldt ook de intrekking van Richtlijn 95\/46\/EG, die nu de Algemene Verordening Gegevensbescherming of AVG-verordening is.<\/p><p>Grondslag voor de verwerking van persoonsgegevens bij banken<br \/>Tegen het negatieve advies van de GBA in om een centraal meldpunt uit te bouwen, besliste de regering-De Croo dat banken jaarlijks de rekeningnummers en rekeninghouders van alle klanten moeten doorgeven. Ook de saldi van persoonlijke rekeningen aan het einde van het jaar moeten worden doorgegeven, zodat deze kunnen worden geraadpleegd door de Belastingdienst, notarissen en deurwaarders.<\/p><p>Hiermee beperkt de grondslag voor de verwerking van persoonsgegevens zich niet alleen tot het \u2018algemeen belang\u2019, maar kent deze ook een \u2018wettelijke verplichting\u2019.<\/p><p>Bijgevolg wordt, wanneer banken persoonsgegevens verwerken, het evenredigheidsbeginsel terzijde geschoven, maar op legale wijze verwerkt onder het bankgeheim.<\/p><p>Voor meer informatie over de rechtmatigheid van de verwerking kan men altijd een erkende DPO
