Costeja Gonz\u00e1lez est n\u00e9e du fait qu&rsquo;en<b> tapant le<\/b><b>nom Gonz\u00e1lez<\/b><b> sur Google<\/b>, des r\u00e9sultats de recherche apparaissaient concernant la vente publique de biens immobiliers appartenant aux personnes concern\u00e9es dans le cadre d&rsquo;une saisie visant \u00e0 <b>recouvrer des dettes de s\u00e9curit\u00e9 sociale <\/b>.  <\/span><span data-contrast=\"none\">Cependant, la vente aux ench\u00e8res remonte \u00e0 de nombreuses ann\u00e9es.<\/span><span data-ccp-props=\"{\"335551550\":6,\"335551620\":6}\"> <\/span><\/p>\n<p><span data-contrast=\"none\">La <b>Cour de justice des Communaut\u00e9s europ\u00e9ennes <\/b>a jug\u00e9 dans cette affaire que les activit\u00e9s d&rsquo;un <b>moteur de recherche comme Google devaient \u00eatre consid\u00e9r\u00e9es<\/b> comme un traitement au sens de l&rsquo;<b>ancienne directive sur la protection de la vie priv\u00e9e<\/b>.<\/span><\/p>\n<p><span data-contrast=\"none\">  En d\u00e9finitive, Google doit toujours disposer d&rsquo;une <b>base l\u00e9gale<\/b> pour traiter ces donn\u00e9es personnelles, en mettant en balance les int\u00e9r\u00eats du demandeur en mati\u00e8re de protection de la vie priv\u00e9e et les int\u00e9r\u00eats du <b>droit \u00e0 la libert\u00e9 d&rsquo;<\/b>expression et du<b> droit \u00e0 l&rsquo;information <\/b>.<\/span><span data-ccp-props=\"{\"335551550\":6,\"335551620\":6}\"> <\/span><\/p>\n<p><span data-contrast=\"none\">En l&rsquo;occurrence, le droit \u00e0 la vie priv\u00e9e de M. Costeja Gonz\u00e1lez a pr\u00e9valu sur l&rsquo;\u00e9ventuel <b>int\u00e9r\u00eat \u00e9conomique<\/b> de Google ainsi que sur l&rsquo;int\u00e9r\u00eat du public \u00e0 obtenir des informations.
