this month because, due to a printer&#8217;s glitch, they received the wrong <\/strong><strong>proposal<\/strong><strong> tax return (VVA) proposal.<\/strong><\/h5>\n<p><span style=\"font-size: inherit; color: var(--uicore-typography--p-c,'#070707'); font-family: var(--uicore-typography--p-f,'Inter'); font-style: var(--uicore-typography--p-st,'normal'); letter-spacing: var(--uicore-typography--p-ls,'-0.027em'); text-transform: var(--uicore-typography--p-t,'none');\"><a href=\"https:\/\/financien.belgium.be\/nl\">The FPS Finance<\/a> is hiring an outside printer to data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Obtaining the wrong RSA is very problematic in terms of GDPR.  <\/p>\n<p>In fact, the proposals contain the following information:  <\/p>\n<p>-the name,  <\/p>\n<p>-income  <\/p>\n<p>-rich registry number of those involved.<\/p>\n<\/p>\n<p>This data is <strong>personal data <\/strong>and falls under the scope of the GDPR.<\/p>\n<\/p>\n<p>Indeed, Article 4(1) GDPR defines &#8220;personal data&#8221; as follows:<\/p>\n<p><em><u>&#8220;all information<\/u><\/em><em>  about an identified or identifiable natural person (&#8220;data subject&#8221;); an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a  <\/em><em style=\"font-size: inherit; color: var(--uicore-typography--p-c,'#070707'); font-family: var(--uicore-typography--p-f,'Inter'); letter-spacing: var(--uicore-typography--p-ls,'-0.027em'); text-transform: var(--uicore-typography--p-t,'none');\"><u>name, an identification number, location data, an online identifier or of one or more elements that are characteristic of that natural person&#8217;s physical, physiological, genetic, psychological, economic, cultural or social identity<\/u>;&#8221;<\/em><\/p>\n<p>The fact that 100,000 Belgians received such sensitive data from other individuals is a serious personal data breach, one can therefore say in this situation that a data breach has occurred.<\/p>\n<\/p>\n<p>According to Article 4 of the GDPR, one speaks of a data breach when the following situation occurs:<\/p>\n<p><em>&#8220;a breach of security that results in the accidental <u>or unlawful<\/u> destruction, loss, alteration or <u>unauthorized disclosure of, or unauthorized access to, data transmitted, stored or otherwise processed<\/u>.&#8221;<\/em><\/p>\n<p>Given the fact that the affected Belgians had access to the national registry number, name, first name and income of other persons and the fact that it is possible to use such data to find out a great deal of information about a particular person, this incident certainly qualifies as an unauthorized access to transmitted data that can lead to serious consequences.<\/p>\n<\/p>\n<p>Data breaches, based on <a href=\"https:\/\/www.privacy-regulation.eu\/nl\/artikel-33-melding-van-een-inbreuk-in-verband-met-persoonsgegevens-aan-de-toezichthoudende-autoriteit-EU-AVG.htm\">Article 33 of the GDPR<\/a>, must be reported to national data protection authority within 72 hours of discovery.<\/p>\n<p>The data subject must also be informed when the breach is likely to result in a high risk to his rights and freedoms.  <\/p>\n<p>Both the nature of the breach and recommendations on how to mitigate possible negative consequences should be reported to him  <\/p>\n<\/p>\n<p>FPS Finance reports that the data breach has since been reported to the Data Protection Authority.<\/p>\n<p>Meanwhile, the affected citizens were also sent the correct RSA.<\/p><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section prevented?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>How it could come to switched declaration forms is not known exactly.
