forgotten on Google <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section <b>concrete facts<\/b> of this case, it is important to go back to the <b>previous problems<\/b> surrounding <b>the right to be forgotten on Google.<\/b><\/span><span data-ccp-props=\"{\"335551550\":6,\"335551620\":6}\"><b> <\/b><\/span><\/p>\n<p><span data-contrast=\"none\">In <b>2014,<\/b> before the <b>entry into force of the GDPR,<\/b> the <b>European Court<\/b> of <b>Justice<\/b> ruled on the right to be forgotten. <\/span><\/p>\n<p><span data-contrast=\"none\">In the <b>Judgment Google Spain<\/b> (CJEU 13 May 2014,<\/span> <a href=\"https:\/\/curia.europa.eu\/juris\/liste.jsf?language=nl&amp;num=C-131\/12\"><span data-contrast=\"none\">case C-131\/12,<\/span><\/a> <span data-contrast=\"none\">there was a dispute between <b>Mario Costeja Gonz\u00e1lez and Google<\/b>.<\/span><\/p>\n<p><span data-contrast=\"none\"> Mr Costeja Gonz\u00e1lez&#8217;s complaint arose from the fact that if <b>the name Gonz\u00e1lez<\/b> was <b>Googled<\/b> search results appeared about the public sale of the buildings of the people involved in the context of a seizure for the <b>recovery of social security debts.<\/b> <\/span><span data-contrast=\"none\">However, the auction dated back many years before.<\/span><span data-ccp-props=\"{\"335551550\":6,\"335551620\":6}\"> <\/span><\/p>\n<p><span data-contrast=\"none\">The <b>European Court of Justice <\/b>ruled in this case that the activities of a <b>search engine such as Google must be<\/b> considered processing within the meaning of the <b>old Privacy Directive.<\/b><\/span><\/p>\n<p><span data-contrast=\"none\"> This means that Google must always have a <b>lawful basis<\/b> for the processing of this personal data, whereby the privacy interest of the applicant and the interest of the <b>right to freedom<\/b> of expression and the <b>right to information<\/b> must be weighed against each other.<\/span><span data-ccp-props=\"{\"335551550\":6,\"335551620\":6}\"> <\/span><\/p>\n<p><span data-contrast=\"none\">In concrete terms, in this case Mr. Costeja Gonz\u00e1lez&#8217;s right to privacy took precedence over Google&#8217;s possible <b>economic interest<\/b> and over the public&#8217;s interest in obtaining information. <\/span><span data-ccp-props=\"{\"335551550\":6,\"335551620\":6,\"335559739\":330}\"> <\/span><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-b73c8be elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"b73c8be\" data-element_type=\"section\"
