A 10-year development process preceded this submission. There was<\/span> <span class=\"NormalTextRun SCXW164217801 BCX4\"> already<\/span><span class=\"NormalTextRun SCXW164217801 BCX4\"> submitted a much more comprehensive and prescriptive draft to Parliament in 2021<\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">, however, it was withdrawn and replaced by the current <\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">streamlined<\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">, principles-based draft that was introduced for consultation on <\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">November 18, 2022<\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">. A  <\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">extensive<\/span><span class=\"NormalTextRun SCXW164217801 BCX4\"> consultation process<\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">s<\/span><span class=\"NormalTextRun SCXW164217801 BCX4\"> and <\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">there were <\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">some<\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">  dozens of discussions at the highest levels of the ministry. The ministry of e<\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">lektronics and <\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">i<\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">nformation technology <\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">has <\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">ultimately <\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">the<\/span> <span class=\"NormalTextRun SCXW164217801 BCX4\">first foundations laid <\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">for the development and adoption of tailored Indian legislation that seeks to strike a balance between enabling easy business and protecting sovereign imperatives<\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">, <\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">civil rights<\/span><span class=\"NormalTextRun SCXW164217801 BCX4\"> and data protection<\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">r<\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">ming<\/span><span class=\"NormalTextRun SCXW164217801 BCX4\">.<\/span><\/span><span class=\"EOP SCXW164217801 BCX4\" data-ccp-props=\"{\"335551550\":6,\"335551620\":6}\"> <\/span><\/p><p><span class=\"TextRun SCXW62596970 BCX4\" lang=\"NL-NL\" xml:lang=\"NL-NL\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW62596970 BCX4\">As a concise 33-page document written in simple language with several illustrations, the bill represents an important, almost anachronistic departure from dense and <\/span><span class=\"NormalTextRun SCXW62596970 BCX4\">prescriptive approaches<\/span><span class=\"NormalTextRun SCXW62596970 BCX4\"> of the <\/span><span class=\"NormalTextRun SCXW62596970 BCX4\">legislation<\/span><span class=\"NormalTextRun SCXW62596970 BCX4\">and<\/span><span class=\"NormalTextRun SCXW62596970 BCX4\"> on the protection of personal data<\/span><span class=\"NormalTextRun SCXW62596970 BCX4\">, such as the GDPR,<\/span><span class=\"NormalTextRun SCXW62596970 BCX4\"> which until now have been the focus<\/span><span class=\"NormalTextRun SCXW62596970 BCX4\">. Some of the key targets and elements of the PDPB are as follows:<\/span><\/span><span class=\"EOP SCXW62596970 BCX4\" data-ccp-props=\"{\"335551550\":6,\"335551620\":6}\"> <\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-77da7564 elementor-icon-list--layout-traditional elementor-list-item-link-full_width elementor-invisible elementor-widget elementor-widget-icon-list\" data-id=\"77da7564\" data-element_type=\"widget\" data-e-type=\"widget\" data-settings=\"{&quot;_animation&quot;:&quot;fadeInUp&quot;,&quot;_animation_delay&quot;:400}\" data-widget_type=\"icon-list.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul class=\"elementor-icon-list-items\">\n\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<i aria-hidden=\"true\" class=\"fas fa-check\"><\/i>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">the establishment of general ground rules, several elements of which, such as consent, purpose limitation and data minimization, were tightened during the consultation process;  <\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<i aria-hidden=\"true\" class=\"fas fa-check\"><\/i>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">provide some guidance through delegated legislation on concepts such as the manner of parental consent and privacy notices. Other concepts such as reasonable security practices and technical and organizational measures are left open to interpretation by the authorized entities themselves;  <\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<i aria-hidden=\"true\" class=\"fas fa-check\"><\/i>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">creation of a special body, the Data Protection Board, to handle unresolved complaints and potentially impose material fines with recommendations to ban applications and services from repeat offenders;  <\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<i aria-hidden=\"true\" class=\"fas fa-check\"><\/i>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">establishing appeals to the Telecom Disputes Settlement and Appellate Tribunal, and then the Supreme Court.
